Seller Files Bankruptcy During Sale of Modular Home and Doesn't DiscloseWhat is the name of your state? North Carolina My wife and I purchased a modular home from a company that had filed bankruptcy and was "bought out" by another company. They did not disclose this information until after our sale was complete and only then by notice of letter in the mail. The problem is, we had several "warranty" issues that the trustee keeps giving us the run around with and no one seems to know the answers as to "who" is responsible now for our warranty. My question is: Is the company that is seeling you the home "required" to disclose information about them filing bankruptcy or selling out to another company? |

| How did you not know? Didn't the title insurance commitment call for the conveyance to be by Trustees Deed and that a requirement for insuring the sale was approval by the BK court? What type of deed were you shown at the closing? Was it a Warranty Deed signed by the seller or another type of deed?? I'd be pretty shocked if the title report failed to disclose any information that there was a bankrupcy.
