Seller Forcing Settlement Date


What is the name of your state? Virginia

I am purchasing a $600,000 home. We received out settlement/closing date for November 27 - THE DAY BEFORE THANKSGIVING!!! This is a problem because I live in New York but my new house will be in Va. I want to Settle the following Monday, Dec 2.
I told buyer NO WAY! That is a bad day. He says YES WAY! It HAS to be Nov 27 or earlier. I don't have an attorney - don't really want to have to get one-I do have legal (unofficial) council though. When we signed original contract before construction - it states At the Seller's discretion, they can charge us 1% of Sale Price. That is at THEIR discretion. They have not threatened this. My thing is....are they willing to lose out on 600 Grand for a date change of 2 business days?

What is the worst that can happen if we refuse Nov 27?

**A: what closing date is stated on the accepted contract? Then use that date and have an attorney review your contract.

The builder is now suggesting that they fedex us the settlement papers on the 25-we receive on the 26th....we review and then sign where noted on the 26th (same day we receive them, of course) and then fedex them back so they can receive on the 27th. What do you think of that?

The contract said Nov/Dec for a settlement date

**A: what nonsense. The closing date should have been a specific date like Dec 10 2002 or based on a specific number of days such as 20 days after the CO is issued.
