Seller trying to back out a week before closing

What is the name of your state? Texas

My brother is buying vacant land from a private seller (no RE Agent involved). full asking price was aggred to by both parties.
A contract was signed by both parties. Earnest money has been accepted by the sellers Attorney. Closing is suppose to occur in a few days.
Appently the seller received another offer for a higher dollar amount and is now trying to kill the deal.
Appently the sellers attorney told the seller he is obligated, but now the seller has fired that attorney and working with another.

I have advised my brother to get an attorney. He is not in Texas.
1. Should he seek an Attorney in Texas or does it not matter.
2. How binding is a TREC contract, can one back out with out any repercussions.

Please advise.
