Seller violating the disclosure statement.


What is the name of your state? Michiganundefined I recently bought a house out in the country with a barn that has bats. Which is really no big deal. Well, I've had 3 bats in the HOUSE in the 3 weeks that I've lived there.
The previous owner did not disclose this on the disclosure statement. After reading about how I can get rid of the bats, I have found evidence of the previous owner's using steel wool and newspaper up in the cracks where the roof meets the ceiling on the first floor inside the house. So I should be able to pull out some of the newspaper to get a date from it to prove that the previous owner actually had problems with them. Our real estate lady contacted his real estate lady to find out if he had any problems with bats. He denies ever having had problems with them and his real estate lady seems to think that when he moved his belongings out of the barn, this disturbed the bats and they migrated to the house. This cannot be the case. I believe he is lying and I am wondering if there is anything that I can do about it. I really don't want to have to fork out $1000.00 plus dollars to have them removed.
Any advice would be appreciated.

and, of course, you are an expert on the migratory habits of bats? I doubt it. Because bats require a quiet, dark place to gather and if he actually did move belongings out of the barn the swarm would have searched for a similar place, including the house.

And all that will prove is when the holes were stuffed. not WHO stuffed them there.

You will need more proof than what you have or can get now.

you don't have to spend that kind of money getting rid of bats.

They do however tend to inhabit homes which they previously lived in.

You need to do the following.

1) buy or build a couple of bat houses and put them on each side of the barn.
Build - 20 bucks, buy: 100 bucks each

2) In the FALL , WINTER or LATE SUMMER ONLY!!!!. plug up holes, Find main exit hole by looking for thier droppings. check online about bats, they have a simple exit only opening you put accross the main exit. They can get out, but cant get back in. DO NOT do this during the spring or early summer, they have young that cant get out. They will die and smell.

3) they are very good to have around. I have a couple of bat houses and encourage them to live on my property. actually if I had a barn I would probably let them live in there if I werent using it.

Per an expert I recently heard on NPR:

Bats don't like moving air and they don't like light. Simply run a fan or two in the attic/barn and put a light on a timer to turn on each few hours. They will abandon that environment.

And put out some bat houses to try to keep them around. Great insect control.

**A: even if the Seller knew, simple economics would dictate that you do not hire an attorney for $2500+ to resolve a $1000 problem. It is simply not worth it. Deal with the problem and move on.
