Sellers Freaking Out

We took your advice (several of you) and had to hire an attorney to fight for us...the sellers tried backing out because they did not like losing money to pay back their bankruptcy debts and they're divorcing so it's even messier. They have until noon Monday to close on scheduled date or get ready to be sued by us...the husband (not in bankruptcy) has seen the light and wants to sell...his wife (in bankruptcy and lied about all kinds of things on the disclosure statement) still believes in the tooth fairy and that God will intervene here and we'll go away.

The sellers wanted to fire their real estate agent because they did not want to pay her commission after working to sell this house for a year, and wanted us to drop our realtor as well. (we didn't) The contact for sale was already signed and agreed on by all and now not only do we have an attorney, her real estate agent has an attorney, our real etate agent has an attorney, the seller's husband has an attorney, the wife of the sellers husband who is in bankruptcy and tried to hide the fact that she was selling the house has her bankruptcy attorney (5 attornies involved all together).

My question: How long is the sellers real estate agent under contact with them? The closing is the 29th of April (may or may not happen depending upon their decision). Their real estate agent's contact would run out nomally the 30th of April. Are they still bound because the contact is in letigation? And who has to pay for all these attornies? We're going after damages as well as specific performance (thanks to you guy's sound advice). We're amazed at how stupid the wife of this twosome selling the house continues to be.

The offer occured while under listing contract. The agents involved are entitled to their commissions regardless of whether the listing now expires. So - if any of the parties think that "waiting out the listing contract" will make the commission go away, they are sadly mistaken.
