Seller's Improper Disclosure

I recently purchased a home in which the seller advertised the home came with a ten (10) year tax abatement. I asked for this "certificate of abatement" at closing and was assured by my closing agent this would be obtained at seller's closing. Two week's after closing, the seller was unable to produce the abatement certificate. I contacted the local assessor's office and was informed the seller never applied for said certificate. I submitted a letter of intent to the seller and have been unable to get anyone to reply, including my closing agent, to my queries as to the status of the abatement or if I actually have any recourse. Can I obtain legal service and take the seller to court for the loss of income due to her improper disclosure? The home has been completely redeveloped and now assesses for a substantial increase in property taxes. Thanks

Did the contract contain any language for the Seller to produce the certificate?

If not, go after the Listing Brokerage**************..they should not have advertised the certificate without knowledge of its existance.

The Brokerage is most likely in violation of State Law and the NAR Code of Ethics.

Next time get the paperwork way before closing. You should never have closed without the papers.
