| I bought a home 6 yrs ago with a friend in North Carolina. Since then she quit claimed the Deed over to me. However, she is still on the mortgage because I could not refinance due to my circumstances. I am getting ready to sell the home. She is having major surgery soon and may not be able to be present at closing. Does she have to be at closing? What can we do so she doesn't need to be at closing. Thanks |

| If she deeded all her interest to you, then she is not a title holder of record and therefore does not have to be at closing to sign the deed to the new Buyer. Her only interest in the property is as a mortgagor on the loan. If she was on title, she could still close away from the closing office as long as she can have her requisite documents notarized. Another option woudl be to have her execute a Specfic or Limited Power Attorney so that you are able to sign for her as her Attorney-in-Fact. |
