Selling Home


What is the name of your state? New York

THe Attorney for Barbara, who is very ill battling cancer, has been trying to obtain a Pay Off figure for the sale of her home. The property was in pre-foreclusure because she ran out if funds due to medical expenses. The lender hired an attorney to handle the foreclosure. Barbara filed Chapt. 13 and has accepted a purchase offer on the home over 3 months ago which will pay off all creditors (3). The buyer has paid money into Barbara's lawyers escrow account and the buyers' lender is ready to pay the remaining funds into the escrow as soon as the one Pay Off figure is furnished. The lawyer for the creditor bank has stonewalled for more than 40 days refusing to furnish the necessary information. It is apparent he either is trying to force foreclosure and/or keep building charges and fees which are accumulating at over $200 per day. We believe that this is completely unethical on tha part of the lender's attorney and want to use any means to force him to comply. Barbara has already suffered financial AND mental damage due to this totally improper action on the part of the lenders attorney.
What can de done??
