Question

I live in Tennessee. I am currently trying to sell a home. This is a home that i and my husband currently occupy. I am owner of this home with my exhusband and i was awarded the property in our divorce. The divorce decree states that my exhusband is to quitclaim the property to me ,so that i can refinance it in my own name or sell it with all equity coming to me. I do not work and therefore cannot refinance the mortgage into my name. However my current husband is employed and with a good income and excellent credit and can qualify for the loan. My question is-is it legal for me to sell property to my husband? Due to the fact that my state is a community property state. Would't the fact that my exhusband is the only one listed on the loan (both of us are on the title) be the exception factor if this is the case?

The sale to your current husband would suffice and actually be a good idea provided that you will also be on title.
