Question

I am looking for a real estate agent and have had some bad luck with one already. I had built a house, Jan 2000 that was way over bid ($40,000.00 over) and now has forced me to sell. The last realtor was found advertising the house for $5000.00 less than the signed agreement and so I cancelled that agent and also reported to BBB. But now I am looking for an agent to sell the house and do not want to end up paying any more money for closing, etc. I basically want to let go of the house without going through foreclosure and paying any more than I have already. If a realtor sells the house for a price that would not get the commission originally set, do I have to make up the difference? Or can I make an agreement beforehand, stating if they have to lower the selling price,I will not be responsible for any loss in projected commission or closing costs? Too many first time experiences with this situation. I am in rural northern Minnesota.

You should put in a clause in the listing contract that the listing agency get either a fixed amount commission or a percentage of the sales price. Realtors do not pay closing costs, the Buyers and Sellers do.

Notwithstanding, if the real value of the property is $40K less than market value, you would need to pay this amount in cash at closing.
