Question

Seperate Maintence and buying a house


What is the name of your state (only U.S. law)? Michigan
My husband (ex) are on a not fully divorced but on seperate maintence, we were living apart and now have been living back together for over a year, we have 2 elementary age children. We are buying a house but only his name is going on the mortgage. The Mortgage company that he has decided to go with has told him that my name does not have to be put on the house because we have already divided our assets( which were none) just custody of our kids. It is not stated in our divorce papers about any future debt. The two mortgage companies we talked to before this one told us that my name would have to go on the house even though I was not on the mortgage because we were still legally married. I cannot find the law regarding this issue in michigan online. Thank you We did put a bid on a house today

**A: there is no specific law on this and the requirement is basically a lender requirement. You should require your name to be on title regardless.
