Question

Shady Closing in Florida

What is the name of your state? Florida

I was the seller. I closed on a condo this afternoon. I made an agreement with my agent to pay for 6 months of HOA fees and some extra money to the buyer. The total was over $2k. The strange part was that nothing was in writing and I was told to give the seller my personal check at the closing, but not to let anyone see. The check was made out to the condo association.

1) Is this legal?

2) I owe past HOA fees, since I have nothing in writing on where the check goes to, can I call the association and tell them the check I wrote is for my past due HOA's? I know this is wrong, but the whole transaction I've been taken advantage of because of the rough market here. (from agent fees, supplying a new A/C, my partner not paying his portion leaving it to me and now the HOA's).

Since it's closed now, I would like to 'get back' at these guys. Again, I know its wrong. What would you do?

Thanks in advance for your suggestions! HunterWhat is the name of your state?

You answered your own question - it's wrong.

Ok, yes I agree with you, it is wrong. Is what they did right? How do I claim this on my taxes? Just make something up and it's a write off? It's obviously underhanded. What is the solution to make this right?

**A: contact a CPA. Your agent is an idiot. Did you use escrow?

You want to "get back" at the new owners because of agent fees, a new A/C, your partner, and the HOA by SCREWING the people who purchased your property?
You're an idiot. I hope you get caught.

"Getting back", not in the literal sense. I want to make it right, what they did is illegal and non-documented. I was pressured into agreeing b/c of the tight market. I can't get "caught" for anything, because I did nothing illegal.

Okay. You win. I completely misunderstood what you wrote.
