SIL used my address on seller's residency cert/exemption

What is the name of your state? New Jersey.
When I married my husband, his sister had the same name, so I have legally used my name-his name. She has a shady past, she took care of their aunt, especially her money. She has to "put some back" for medicaid purposes. She just sold the house she bought with said money and is moving to NY. I looked up the deed information to see what she sold for. There on page 3 and 4 are two Seller's Residency Certificate/Exemption forms with MY name (minus my nee and the hyphen) and MY address. Under seller's assurances they checked box 2 which reads "The real property being sold or transferred is used exclusively as my principal residence within the meaning of section 121 of the federal Internal Revenue code, 1996 U.S.C. s. 121."

Who is she trying to defraud now? Is she trying to get out of paying taxes? She bought the house 3 years ago for 299k and just sold it for 310k. If there is a tax gain, it can't be much. I soooo don't trust this witch. My husband wants to give her 30 days to rectify it. On day 31 should I call the county clerks office and/or the IRS? I would love to see her get what she deserves. Please let me know how to handle this. Thanks. b. & happy holidays! What is the name of your state?

Contact the IRS NOW about the possible identity theft and/or fraud. Your delaying a response will only show you are supporting her conduct.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Your husband is an idiot and you are too if you listen to him.

First, your sister-in-law using HER name (i.e., which is the same as yours except she did NOT use your maiden name with hyphen, so that is her name, duh) is perfectly fine. Not sure why you are nosing around but so be it.

Second, her using YOUR address is odd, very odd indeed. She isn't selling your house so did she just need a mailing address or what was the purpose of using your address with HER name??? Especially if the home being sold was her primary residence. There aren't any tax consequences if that is the case. Also, she didn't use YOUR SSN so I'm not sure what all the hubbub is at this point. If someone can enlighten me on what I'm missing here, please do so...

Glad you aren't in my family snooping around. Unless she used your SSN there is nothing the IRS wants to know because with them we are just a number and based solely on the info provided there is no gain that would be taxable.

So did she use your SSN?

My husband's other sister asked me to look up what price she sold for. For some unknown but fortunate reason, I happened to click on page 3 and there was my address. I don't think she has my ss#, I pray she doesn't. I know she used "her" name, but using it with my address implies that it is me. I believe she is trying to avoid paying capital gains tax on the transfer. All of the nasty things she has done to the family is more appropriate for the Jerry Springer show. My husband is nicer than me and has given her a chance to recify the situation. I am writing their closing attorney to confirm my knowledge and uninvolvment of the situation, and if it is not corrected I will be contacting the DA, IRS, and the NJ Dept of Taxation.

OH BROTHER! Why don't you find out what happened first. As was suggested she may have used your address as her's was about to expire with the sell.

Your husband might be the sane one here until you find out exactly what happened!!!!!! Have you checked your credit reports lately?
