Spouse only on Home loan?


What is the name of your state? Texas

My girlfriend and I are in the process of buying a new home, and our mortgage compnay is telling us we can get a better rate/deal if only mygirlfriend signs for the loan, but both of our names will be on the deed. We will be getting married in the next couple of years, however if we split up where do i stand w/ rights to the house?

How so? If we split up before we get married and the house is sold am i intitled to 1/2 the profit if any? I make more than her and would be paying a majority of the monthly payment, but dont want to be throwing that money away.

If your name is on the deed, you are 1/2 owner, period. If you split you get 1/2 of the profits, she can not sell it without your signature.

BUT, the loan on the other hand: If you split up and she stops paying for it since you make more money, her credit is ruined, yours is free and clear!


We put my name only on our home loan, simply because I make more money, and hubby is self employed, so he is harder to prove on income. But his name is on the deed, and we are in a community property state, nothing to worry about.
