Question

stuck with a leaky roof


What is the name of your state? California
We purchased a house back in September 2005, everything seemed perfect. about a month after we moved in we realized the roof of the house is flat yet who ever roofed it put on a shingle roof we informed the realtor and the broker: and they gave us a guarantee that the roof is good for another 5 to 7 years, its been 6months that we move in to our new home and it rain in January and the roof leak we call the realtor and we got nothing . February came and went we got more leaks still nothing. March came and went more raind more leaks and nothing. so we got a few estimates from roofing contractors and it cost between $8,000.00 to $10,000.00 to fix the roof. The realtor and the (broker)previous owner are offering $2,000.00 to repair the leaks but there are so many leaks that any roofing contractor that has seen the house tell us is beyond repairs the the roof has to be replaced for the leaks to stop. Is there anything we can do because its only been 6months since we purchase this property.

If the roof is in such condition then why did your inspector not find it when he/she did the instection for you?

Do you have a disclosure statement that addresses the roof and if so what does it say?

You can go to small claims for the maximum recovery in your state (IF you have a case) and eat the rest or sue for the full amount and pay an Atty most of the overage you might recdeive over a small claims case.

There was a general inspector who did the whole House inspection and when he got up on the roof it looks fairly new Im guessing a couple of years. we got a Proposal & Acceptance Contract from the realtor that states as follows: Original demensional shingle roof which looks to be in good condition and should be a viable roof for at least 5 to 7 years. This Guarantee transferable to new owner.

**A: is the guarantee from the roofing material manufacturer or from the licensed roofing contractor? If not, you have a toilet paper guarantee. Why did the home inspector not comment that shingles are not the right tyoe of material for a flat roof?

the guarantee is from licensed roofing contractor.

I had a similar situation a couple of years ago except it involved windows that were leaking pretty bad. I had a really good lawyer in Redwood City - David Del Buono. (I live in San Francisco.)

In my case, we got the sellers to make good after a few stern letters. They had a contractor of their choosing come out and fix everything up.

I hope things work out for you.

BTW - My roof's leaking now too. We've had so much rain lately.
