survey issues with previously forclosed property


fl; i bought a forclosed property last year. now i'm trying to sell it. i did not have a survey at my purchase, but my buyer wants one. the survey shows that the home is encrouching the neighboring lot. what are my options? can i legally acquire the original survey? what course of actions should i seek?

It apears that you already have a copy of the original survey. If the survey is correct, consult an attorney to see if an encroachment agreement can be done with the neighbor.

the survey tht i have is the one that was performed for my buyer. the home is a mobile home, and i can't help but wonder how it passed all of the original inspections. where can i find information about te original inspections? and, if there is an issue with the inspections, can i take any action against the forclosure company that i bought this property from?

Contact your local building and zoning departments.
When property is purchased at a foreclosure/BK/tax auction/sale, the Trustee sells the property "as-is". Therefore, you have no claim with respect to condition of property, encroachments, environmental hazards, building and zoning code violations etc.

What are you talking about??? This is an open forum based on sharing opinions. If you re-read my responses to HOMEGURU you will see that my ONLY OBJECTIVE is in making sure he provides accurate responses - which does not happen most of the time. I sincerely believe some of the advice posted by homeguru could harm someone if they followed it.

Your threat to have me removed/cancelled is ridiculous for challenging another posters facts. So please GO AHEAD cancel membership if you believe an an OPEN FORUM is a problem.

I hope this reply is not construed as 'messing' with a contributor, I wouldn't want to challenge another contributor into supporting a posts - that would be awful wouldn't it!

My response:

Don't play coy with me. You know exactly what I'm talking about. I said, "Play nice", and I mean it.

You have every right to add your comments to a thread, and to discuss issues. You can even make corrections to the writings of the other contributors. No one, least of all me, would ever want you to do otherwise if you felt the need, and can add something constructive. Just do it nice, without all the extra verbiage.

Don't get personal with the contributors by saying someone "is a joke" and other such phrases.

I realize you don't care, but I've dealt with people far worse than you - - and guess what ? They're gone. So, start caring if you'd like to stay.

In final conclusion to this issue, you can either be a "welcome addition" to these forums, or you can be a pest. It's your choice. But, you've been warned that the latter choice will make your stay here very shortlived.

Looking forward to reading more from you.

Thanks for the welcome wagon - It would have been more effective had you chosen not to threaten me -

I'm surprised you didn't exert your tremendous power over the 'junior' member and have me abolished.

As noted, my only objective is to post/clarify issues I feel are posted in error and to assist those on issues I am familiar with. If you continue to 'threaten' me I will have no alternative but to bust out crying and enter into a deep depression - who knows I may even lose my sanity over this.

My advice to you is simple.. Don't threaten someone with an act you cannot support. I have NO DESIRE to enter into a dialogue such as this, so please don't reply with some threat about cancelling my membership its a waste of your time.

Elvis, if it makes any difference to you, I stand right along side both IAAL and HomeGuru on this issue.

I have already shown on another thread where your posts were incorrect and you even admitted to some confusion about laws versus rules. That issue is closed. However, your ONLY post on this thread to date had added no value to the thread... but was clearly intended as a 'jab' to instigate another batch of angry cross-posts.

And, though I do not use the threat of 'banishment' or censorship lightly, your continued abuse and personal attacks will not go without a response from me also.

This forum is SOLELY for the benefit of those people who come here to ask questions hoping to get answers from knowledgable persons. They do NOT expect to be abused or berated... (and that goes for the responders too). The forum owners recognize the value provided by the FREE advice offered in the replies to these questions. With that in mind, they do recognize that when the senior members complain about the antics and tactics of an abusive member, they do respond to those complaints.

In closing... if you can provide accurate and helpful responses to posts, you're certainly invited to do so. However, if your responses are abusive, personal attacks or consistently berating, you will be banished to the hinterlands. How you are treated here is purely under YOUR control.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
