termites 5 months after closing

What is the name of your state? California
wee purchased a house-there was evidence of dry rot typr termite and minor damage was fixed and house was tented. Last week, we experienced swarms of subterranian termites inside the house. The pest control company said the tenting treatment of the house in October was only for the dry rot type-not subterranian. Further, their inspection would not have revealed the presence of subterranian unless the owner told them of evidence such as swarming. Is this true or a weak excuse and a ploy for more treatements? We know we need to have soil treated now but should they have caught this in their inspection?
