termites


I live in Washington State. bought house 2 years ago. I received disclosure statement from the previous home owner before closing. We had a home inspection, no pest inspection. Home inspection uncovered nothing. On the disclosure form the previous home owner marked no previous problems with termites or wood destroying organisms. In May this year we had a termite swarming. Upon our investigating we discovered that the previous home owner had been treated for termites before. We confronted her and she admitted she had had a previous termite problem but thought it had been taken care of. She gave us a copy of previous termite treatment contract. The home has an addition that she ensured us had a "legal crawl space" underneath it. There was no access to crawl space but she ensured it was there. We (in trying to eradicate the termite problem) had an access cut into the concrete to be able to access the "crawl space" and discovered that there was no crawl space and was dirt up to the floor joists. We excavated and discovered a termite colony under this part of the house. This is also where her previous problem was. My question is even though it's been two years do we have recourse? Do we have to prove it's her same termite problem? It took almost 2 years for problem to surface? Thank you

It appears that you have a case despite not getting a pest inspection.
