Virginia- 5 years ago, i entered a sales contract to buy a house from a lady (she owed nothing on home)the contract. at the closing, the atty did not file the sale with the court and the seller said that if i wanted to, i could. the agreement was that i get a bank mortgage before the sales contract expired or in order to walk away, pay her $2000 if i left before the contract was up. all mortgage companies told me that in order to get a mortgage on this house, the salescontract had to be filed with the court. i paid the $ myself and did this. in jan, i found a better deal and got a legit mortgage on another house. paid her the 2k and moved out. now, she has sold the house- and i am being threatened with suit if i don't sign a release on the old house. the closing is on hold for her house. ? is- can i be forced to sign a release if her contract with me did not call for one?
i'm not by nature a vindictive person but literally got 8 calls in one day alone at work demanding i sign my name. can i demand my 2000 back in exchange for my signature? when i sent her the money, i also included a letter advising i was giving up the house 1/31/01 but before we were even done moving, she had a man go into our old house to paint.he even
threw out some of our furniture (i just let it go then) but now i'm not so sure i shouldn't have done something then. |
