title company demands money after closingWhat is the name of your state? CA I hope somebody can help me. I'm a first time homebuyer so I'm in the dark. But common sense tells me that this is not right. I bought his property in september and recorded/finalized on sept25 2006 everything was signed and stamped and notirized. The lender has automatic withdrawal for payments so I assumed everything is settled now and all I do is wait for the property tax bill. So just recently, November 27 2006 I called the title company to ask about the property tax bill to see if I'm liable for anything. they didn't give me answer but instead they tell me they did an audit and there was an error on my closing statement calculations and they need to collect more money (about $2,000.00 more.) so I called the county tax collector and they tell me that I actually don't owe them anything until they "subdivide" the property that I'm not liable for any property tax until they bill me which takes about a year. because its a new house they tell me my parcel number is pooled with eight others and the builder/seller need to take care of that before they can assess my property. so what are my rights? and what am I liable or not liable for? It doesn't make sense to me that thet title company thinks they can "revise" a binding and legal document signed infront of the notary. thanks |

| Your closing documents should state who pays for this years taxes: youself, the seller, or prorated based on the purchase date. If they incorrectly calculated the taxes during the closing process, then yes, they can come after you for the money that you agreed to in the purchasing contract for the property. However, I would be more concerned by the response from the county. According to them, you dont' even own your property yet since the parcel was never subdivided. Find out when that subdivision is going to happen and get the title company involved if your ownership of the porperty is not cleared up soon. . |

| Check your closing docs. I'm sure you'll find a document that says something to the effect that every effort was made to do things correctly, but if there is an error and you owe additional money you will bay quickly. I didn't see in your post where you said that the 2k was for taxes. Are you sure it was taxes and not something else? |

| What is the title company requesting funds for exactly? Unless it's something that was an honest oversight that you should have paid, tell them to go pound sand. As far as the parcel number business is concerned, that is something that DEFINITELY should have been dealt with pre-closing. I honestly couldn't direct you to the right place. You might try the developer/builder to request the proper documents be filed immediately.
