trying to buy out ex in NC

What is the name of your state? north carolina
trying to buy out ex- he put down $ 10,000. moved out 4 months later, i have made 100% of the payments, 6 years worth-- offered him 10,000, he refuses, i want to move back into the house, what are my rights, if we went to court would i win? is this something you can take to court?
