trying to get my house back!

i am co-owner of house in AZ, (jtwrs), left the house 4 months ago because of abusive relationship. he agreed to refi the house and buy me out. he has not done so, he is still in house, not making mortgage pymts, close to foreclosure. can i legally get him out of property so i can refi in my name and take the house back?

Pay the amounts in arrears to get it our of foreclosure and hire an attorney to file a partition suit.
