Two People on title of house can't agree?


I am currently living in Miami, FL with my soon to be ex-girlfriend. We have been living together for about 4 years. After college we decided to move in together, and we bought a house. Both our names are on the mortgage and title of the house. Her income was not taken into consideration when we applied for the mortgage. Her credit rating isn't that great after a couple of bad "college student credit cards" experiences. We bought the house before the florida real estate explosion, as a result we owe about $250k on the mortgage, and the house will sell for about $750k. The house is both of ours equally (we split every payment and all improvements in half), so i want to just sell the house and split what we make 50/50. She currently has a relatively low paying job and bad credit so she would have a hard time getting a reasonable rate mortgage. She wants to stay in the house (its a beautiful beach front house). I want to sell (as my buying power is reduced being on the mortgage, and i am afraid she will not be able to make the payments). What can i do? I want to be fair and do what's best for both of us, but i need the money from the equity to buy a new place for myself. And we're polite and nice now, but i don't want our friendship to be destroyed as a result of her not making payments or using that to "black mail" me if she needs something in the future. The whole "If you don't [blank] i will just stop making payments and ruin both our credit".

She does not qualify to assume the mortgage in only her name, the lender will not take me off the mortgage (due to income and bad credit rating on her part), she also doesn't qualify for a second mortgage to buy my interest in the property.

What can i do? I don't want to go to a lawyer yet because she might still decide to sell, but i am preparing for a worst case scenario. Any help or advice would be greatly appreciated. I know what i should have done 4 years ago, so please don't tell me what i did wrong, i know).

Well, you travel about 70 mph in a straight line then turn the wheel very quickly to one side.....

It's physics.

Damn semi driver had dirty tail lights and no reflectors...by the time I realized he wasn't 1/2 mile ahead of me it was either an imprint of his rear door on my forehead or try to get around him....

Neither worked.

My mechanic is about to divorce me. He spent the last three years restoring it.

and no, scruffy wasn't with me and no distractons. The idiot's rear lights were barely visible (no fog) and with no reflectors on the back he looked like he was far away. Adding to the fact that he was going about 20 mph (just got on the freeway) I was a goner from the beginning.

And yes, the car is toast.

I'm filling out the paperwork now. I have a broken bone in my back but the cat scan revealed nothing more. and the specialist said It would heal on its own if I didn't do too much to reinjure it.

INSUREANCE? Tennessee doesn't require insurance. and of course, Since I am still a legal resident of Austria, I drive under my EU license. I did get 2 tickets, one for no license because they forgot it was in my passport ( no problem ) and another for unsafe lane change (go figure) but that's it.

As far as I know no fault was given at the time. And you should see the ugly bruise on my back. Nice shade of purple. But I stayed in the suv and was able to crawl out and walk around cussing up a blue streak.

What pisses me off about the whole thing is one driver tole the police the semi-driver was doing about 20 and the guy behind me said I must have fallen asleep.

BULLCRAP!. I had just stopped for coffee and a 2 hour rest before starting again. I was wide awake even during each and every rollover....I was waiting to put the wings on.

Thanks bud. He LOOKED like he was 1/2 mile ahead....from what I can gather, he was only a few hundred feet. but that's up to the accident investigator.

and you're right.....it hurts like hell.
