uncorrect closing paperworkfrom Wa state. I bought my house 5 months ago. I was looking through the closing paperwork and found an error on VIII. Declarations. Question1: Have you been declared bankrupt within the past 7 years? Question2: Are you obligated to pay alimony, child support, or seperate maintanence? They were both marked NO on the paperwork, but it should be yes to both for me. Can I legally get out of this house for the error? Would the loan have been approved if the paperwork was correct? |

| Look at it this way . Even with bankruptcy If you were able to make the payments so far why rock the boat .Instead If you think there is a problem with your ability to pay that mortgage why not sell and be rid of it that way . who filled out that paperwork marking no on those 2 things ? Im quite surprised they hadnt said anything to you when you applied for the mortgage . If your bankruptcy was old enough perhaps it was no longer a issue ? |

| I do not think you can "get out of this house" for the listed errors on the Loan Application. If anything, they could be viewed as false statements by you made in an effort to influence a loan decision. There is no doubt the credit report would have had details on the bankruptcy, it must have been some time ago. Regarding the alimony/child support, did the lender account for it in the underwriting? Did you ever disclose to them the amount you are paying? What was entered on Section VI of the Application, Assets and Liabilities ? That section specifically asks the applicant to list alimony and child support. Don't forget, the application is yours, despite the fact that someone else typed it up. You signed it, stating the information is true and correct. Why do you want to "get out of this house" ?? |
