Under Agreement ?What is the name of your state? MA. Is the followng illegal ? The following occured: 1) A contract to purchase a home was signed by a buyer and a seller. 2) Attorneys (buyer/seller) working out the P&S. Prior to the last day on the P&S , the listing broker accepted a offer from another buyer. The 2nd buyer did not know another offer was in progress. Broker said the deal fell thru. The offer was lower than the first offer. The sellers attorney notified the first buyer attorney (seller does not want to make further changes, ...) canceling the orginal contract. My guess , the broker accepted the lower offer to make more of a commission. Second buyer was not represented by a realtor (first buyer was.) . Basically, is it illeagal to enter into another contract while their was a contract on-going. If so , what is the recourse ? ![]() |
