Undisclosed info about faulty sewer line


What is the name of your state? tennesssee

We purchased a house this summer. We are now having sewer problems. The plumber we hired told us that he told the previous homeowner what the problem was but they did not want to fix it- they merely paid for a temporary fix and failed to disclose the major problem. So far, we have paid $2000 and the problem is still not fixed because we are now having problems with the city of nashville. What a nightmare we have had! Can we sue the previous owner for not disclosing this problem?

**A: yes, you can sue anybody for anything.

What did your home inspector say when you had him come back and re-inspect?

Did he provide them with a written estimate of this supposed problem?
Did they disclose this problem in the dislosure statement?
When did you close on this home, and when was this "temporary fix" done by the previous owners?

Irrelevant until you establish if it is/was the previous owners responsibility.

we have not had the home inspector return. we just had the problem appear and have been dealing with it. should we have the home inspector return? there was no way for him to know of the problem since it was 6 feet underground and the sewer had temporarily been flushed out and working.

JETX!!!!!
we closed on the home in july. 2 days before it closed, the bathtub backed up and plumber was called. the front lawn was dug up and supposedly the problem was fixed. when the problem reoccurred just last week, we called the same plumber and it was at that time that he told us about telling the original owners what needed to be done. we will have to check to see if he gave them a written estimate of what should have been done.

So you accepted the house and the repair work because you closed on it after you knew of the problem.

Is that correct?

I am reading it that the new owners closed 2 days after the old owners had the problem "fixed".

Wouldn't that make the plumber liable, or the previous owners, due to warranty?

Until poster clears this up, we are all wandering around out here in the dark and with this sewer mess, I just know I will have to clean off my boots!
