undisclosed report

What is the name of your state? west virginia my wife and I purchased a log home in november 1998. The spring of 1999 we started hearing clicking noices and then seen saw dust falling from the logs. My wife went to the real estate agents requesting to see the pest inspection report . And they couldnt find a copy ,but they told us who performed it . And we got a copy from them stating the home had an infestation of old house borers. Note before we purchased the home we asked for a inspection . And at closing we asked were was the report and the agent said she forgot it at her office, but every thing was just fine you can come buy anytime and get it. So we went on with the closing. On the pest inspection report was a place for buyer ,seller and agent to sign. The only one that signed was the agent. We have a lawyer ,but the agent keeps coming up with excuses to delay our trial its been filed for 3yrs.. My questions are Do you think we have a good case ? And Her newest scheme filing bankruptcy 1 week before our trial delaying it one more time. What can we do about this?
