unpaid lien when house was sold


What is the name of your state? FL

When we sold our house about nine months ago, we were not aware that there was a lein in effect on the house by Wells Fargo - with whom we had negotiated a re-financing some time earlier. At closing, the title company did not discover this lein either. Now - nine months later, we have all become aware of it (I won't go into the details of how it was discovered).

The title company has now negotiated with Wells Fargo to pay the lien, but they want us to re-pay them in monthly installments for the money that they gave to Wells Fargo. Do we have a legal obligation? It seems to me that this was their mistake as much as it was ours.

Please help! Thanks!

**A: if you owe the money, pay it. It's the right thing to do.

That would have been my first choice too. Unfortunately, paying them is not an option. I'm not in the poor house yet, but I don't have $5000 and I was layed off from work this week. I think I'll try and get them to agree to some payment options. Thanks for the advice - it is appreciated.

Does title insurance apply to these kind of situations?
