URGENT: Does taking possession prior to COE help buyer?


What is the name of your state? Arizona

I'm worried that the sellers' agent will talk the sellers into canceling my purchase contract because escrow did not close on time. We extended the close of escrow to today 5/31, and today I had the title co. issue modified escrow instructions to extend close of escrow to 6/8, but have not received a call or signatures from the agent. The original close of escrow was 5/31, then based on bad information from the title co assuring me that there's no reason that escrow on my home that I'm selling couldn't close on 5/23, agreed to move the COE up. I had to cancel the contract on my home because the buyer of my home (and her loan rep &finance company) did not perform (NO communication or docs whatsoever).

Does taking possession of the home I'm buying now help me legally if the sellers decide to cancel my contract? The sellers gave me the keys to the home on 5/19. The agent knows I've done improvements to the home and that's why I feel she will talk them into canceling the contract.

Seller will not cancel


Remeber "bird in hand worth two in bush" they want you money and dont want to begin all over.
