warranties


What is the name of your state? new york
I just purchased a home. First time I tried to use dishwasher did not work even though real estate agent said all appliances worked. Six days later had no water and well pump had to be replaced. Costs about $1000. Do I have any recourse against seller. Did not have a home warranty policy.

**A: was there a seller disclosure statement? Did you have a home inspection? Did you and/or your real estate agent do a final walk through prior to closing to run all appliances and check the plumbing, electrical, HVAC and other systems? Did your agent suggest to you to purchase a home warranty plan?

Had home inspection. He checked structural, electrical service and ran the faucets for a few minutes. Did not open/check the well pump. Did have a disclosure statement but nothing about the well pump. Appliances were not checked because when explicitly asked agent said all applicances worked. Agent DID NOT suggest a warranty policy.

Wells and pumps are not part of the home inspection. You actually have to hire a well company to raise the pump to check it because they are submerged. If you have water to the house, your pump is working and that's the only way you know. They go out all the time and that's a hard one to predict unless you know the exact age of the pump and even then we've had one go out at a year. The inspector should have checked the appliances anyway as that is part of a complete inspection. Best of Luck.

**A: then who did the agent say checked the well pump and the appliances? Did the real estate agent? On what basis and evidence did the agent confirm that all appliances worked? Agent did not suggest a warranty plan? Why? Are you getting the picture now? You agent has some explaining to do. You asked if you have recourse against the Seller, but have offered no proof that the well pump and dishwasher were NOT working prior to closing.
