Water damage


Our house is supposed to close on Jan. 31 in Macomb, Michigan. Everything was going smoothly. We moved out of the house on January 11 and moved back to Canada so the house has been empty for two weeks. It has been checked several times by our realtor and was fine.

A few days ago, the buyer was walking around outside and looked in the window. She noticed that the skylight in the kitchen was hanging by a thread and there was some water damage. What happened was our movers improperly removed the water without clearing the pipes and water slowly dripped over time until the light fixture gave way. The home has been re-inspected and there is no further water damage.

We are willing to fix any damage that has occurred but are unable to have it done by closing. She does not want to close now until it is fixed. This will cause a lot of hassle. What are our rights?

You must either fix the problem prior to closing or have the Buyer accept a holdback of 150% of the amount to fix the problem and close. The monies held in escrow will guaranty payment for the completion of the required work.
