Water found in basement day after closing


What is the name of your state? Illinois

We rec'd a call from our realtor the day after we sold our home stating that the buyers discovered wet carpet in the basement. We have never had any problems in the basement and were not aware of this situation. The buyers then tore off the drywall and discovered mold and a leak from under the kitchen sink/dishwasher. They have now sent us a letter requesting that we pay for all repairs totaling $3,800. The buyers had a home inspection completed prior to closing and no one mentioned anything after the walk through. Our attorney suggested that we turn it into our insurance company. Our insurance company has sent us a check in the amount of $1,800, but mold is excluded. The buyers have sent us another letter requesting that we pay the entire amount due or they will be taking us to court. Is it worth all the hassles of going to court? Are we liable? The buyers have even said in a letter that we could not have been aware of the situation, but they refer to a section in the contract about all mechanical systems must be in working condition. As far as we knew, they were all in working condition.

Send the Buyers a letter along with the check from the insurance company.
Have your attorney help you with the contents of the letter.
