What can we do?


What is the name of your state? NY

We are selling our home and waiting to close. Our contract date to close was June 15th. Our buyers are selling their home. Their buyers are holding everything up. We don't know why though. OUr lawyer said he wouldn't know because he's not involved with their sale. They keep telling him that they are trying to schedule the closing but this is going on for a few weeks now. In our contract, the mortgage amount in the contingency statement was for the sale amount less their down payment so that they can still close. Can't we force them to close now even if their sale hasn't been completed? Our laywer sent a time of the essence letter for a closing date which as now passed. Wouldn't we know if there is a problem by now?

What did your contract state as a penalty if the house didn't close on time?
