what to disclose when selling

we will be putting our home on the market soon. our neighbor
runs a home based day care. our yards are fenced and they
have been considerate about the childerns outdoor play time
and pick up and delivery so as not to be disturbing or
noisey. (this was not the case orginally but things have worked
well for the past 4 years)

our friend who is also our real estate agent has told us in the
past that we do not need to disclose the day care. (it was never
disclosed to us 6 years ago when we purchased the home)
now he claims we need to disclose this information. to make
matters worse the neighbor on the other side has opened a
day care also.

i feel this would deter people from purchasing our home. is
this something we legally need to disclose?
