What do I do?


What is the name of your state? California, San Fernando

Hello Everyone,

Here is my situation.

My brother and I bought a duplex together for my mom.
We used our credit my mom paid all the expenses.
It is a duplex with a loan of about 225,000.

She lives in the back unit and a tenant is renting the other unit. I moved out after having problems with her paying her half of the rent. The original agreement was to get the property with my brother and I and she would then refinance the refinance the property in her name. it never happened. Today she called me wanting for my brother and I to refinance the house. But i told her no I didn't want to be a part of it. She threatened me with late payments. I suggested she move out and she refused. In the future I'd Like to buy a property for myself and My family.

I want to ask her to leave. But she is a real estate agent and i don't know what she can do. Also she only made 8000 last year. Any suggestions? I haven't talked to my brother yet but I will have too. I am 24 years old that's my biggest debt and i want to get rid of it. Either she refi with my brother or we rent it out or we sell. I don't know what to do. She has another house in her name. Please post in you need further information I will try to provide it. i am trying to be generous but it's not working.

**A: so what if she is a real estate agent. Her being a real estate agent does not allow her any more rights as a property owner than a non-real estate agent.
Tell her you will file for partition.

Now on the same note i have a couple more questions.
How much does filing a partition cost?
Do I get an attorney?

Also on another incident.

My father bought a house in around 1985.
both my parents are on the Loan statement but only my mother
and I are on the title. In 1996 my father had spinal cord surgery and thought he might not make it so he relunctantly signed a quit claim deed and then signed his part over to me. Now my parents are separated my mother lives in the other house. my dad wants a divorce, by the way he is permanently disabled and lives off social security. Now he lives in his house with my sister and her family (husband, son, coming baby) what rights does he have.? Can I give him his share back?
Do i kick out my sister?
She is terrible by the way, has to have things her way.

Do I get an attorney?


What is the best thing to do?
