Won case and still battling


What is the name of your state? Georgia
We recently won our case against our builder, who decided he was going to raise the price of our home 35K without an explanation other than cost of materials had become inflated. We filed lis pendenz, but he found yet another loop hole in the law. He moved his family in the house and leased the house to them while we battled in court. Upon investigation, we found that he wrote a contract to his family which he would sell the house we were under contract to him for almost 100k more than our contracted price. The judge awarded us our house at 269K, and ordered the leassors to move out within 30 days. Since then our builder filed an appeal and is threatening to file bankruptcy or foreclose on the house and the people leasing the house from him are still there. This builder still holds our earnest money as equitible interest for the house. We have tried to negotiate with the builder as he claims he has put over 45k into the house more than was loaned on the house. Everytime we get close to an agreement, he makes more demands. Is there NO RELIEF IN SIGHT???? Is there nothing that can protect us if he decides to go belly up? We have been in this battle for over a year, and thought our prayers were answered when the judge ruled in our favor. It seems there are more laws to protect people who are dishonest than the ones who aren't.
