My wife has custody of her three children, and her ex has visitation every other weekend. Our 16 year old son has decided he wants to live with his biological father, and has refused to come home after their Christmas trip. His grades have fallen to failing levels and he is passively asserting that he cannot be forced to return to our home. We picked up the other two children last night, leaving the son with the non-custodial parent.
We do not believe that we can force the son to do anything he doesn't want to do, and yet, we do not feel comfortable being forced into this situation. The biological father wants custody to be signed over to him, and while we do not feel this is ultimately in the son's best interest, we do not feel we have much say in the matter.
Does this situation require a custody change, or can my wife and I maintain custody although the son does not reside with us? Where can we go from here?
