Florida Case
DCF placed the child with the father (no Paternity action) at birth due
do mother being on Drugs and Baby born with drugs in system.
Because the mother agreed to this no Paternity action was ever done and
DCF said she needed to complete drug treatment to have the child. She
never did.
She and the father stayed good friends and often lived with him. However
in the middle of the night she took off with the child to another state.
The father went to that state 2 days later and brought the child back
to Florida. The other state filed child abduction charges against the
father. He was arrested and child went back to mother in other state.
Once out of jail next day, Paternity action filed in Florida, Florida Court
demanded child be returned to Florida and with father.
There is not Sole Custody in Florida but shared parental responsibility
where he has her 3 weeks and she gets her one week a month. Child
is 2 years old.
The question is this..
The mother has no transportation or DL and she is requesting the father
drive the child 10 hours each way to allow her to visit her child.
What will or can the courts do in this.
Thanks in advance. What is the name of your state (only U.S. law)?
