We live in California

My daughter has a 8 month old baby girl. The bio dad was never listed on the borth certificate. Until today he has shown no interest in being a parent. In fact 2 months after she was born he moved across the country with his current girlfriend. He has never paid any support and has only seen the baby 3 times for total 4 hours. Suddenly he's feeling paternal and intends to move back to CA. this spring and be a dad. Can he force a DNA test to prove paternity and what chance does he stand of getting custody?

Yes, he can file a lawsuit to declare his paternity and to get custody or visitation.

What will happen no one knows.

yes of course he can. he will get visitation barring any unusual circumstances, it may be supervised at first because he doesnt have a relationship with the child, but eventually it will not be.

Legally he wasn't obligated to pay support if there is no court order for it. She should have filed for all of this on her on when the child was born and then she may have a had a leg to stand on as far as limited visitation but as it stands, once paternity is established and he gets to know the child and vice versa, he could file for joint custody.

Legally he doesn't have to pay child support right now since there is no order to, but a judge could still enforce back child support on the time he didn't pay if you ask for it.

He will get visitation, limited probably at first, but than more as time progresses.

It happens a lot, men's conscience gets the best of them and they decide to be a father. Thing is that is good in a way cause the child needs a father and it is better when the one the child has wants to step up to the plate.

Hopefully once he gets started being the father he will stay that way and the child will grow up knowing both his mom and dad.

I know it stinks, but it is for the best and I hope your daughter can work with the father and not fight him.

The problem is he's a deadbeat and could'nt hold a legitimate job if he got one because of past DUI's. His license revoked, if he tries to get an ID in CA. they go after him for fines etc. No-one wants him in their life. Anyway to stop him from establishing paternity?

Apparently your daughter did, enough to sleep with him 17 mos ago at least.

And no, there is no way to stop him from establishing paternity. Nor from filing for visitation, which he will get in at least supervised form.

No there is no way to stop him. Although you may not think that he is a good person, his child does deserve the right to get to know him. Whether or not he chooses to make that happen at this point is totally up to him.
