What is the name of your state? OH

My boyfriend just heard from his ex wife that she wont allow me to enter her property to pick up their son for his visitation...not that I would get out of the car or anything...but they live on a busy street and have a long driveway...I would like to know if she has this right.

As long as your boyfriend is picking up the child on his visitation time and you are just going along for the ride she can't tell you to not come.

because we have to actually drive into her driveway to get possession of the child she is saying that I cannot, because she doesn't want me on her property...is your previous reply still correct?

My response:

If a landowner says you do not have permission to enter the property, then you take your chances as a trespasser. Stay OFF of her land.

I do hesitate to go but he wants me to be there because she has filed false claims of violence against him..and there is no sidewalk.
I have suggested he take someone else but he hates that she can dictate to him who he can have in his car...Thanks for your help, everyone.

Have your boyfriend call the local sherrifs department and ask them if they can escort him there or if it gets to be too much of a hassle you could ask the courts to modify the visitation and have it done in a public facility, such as a visitaiton exchange buidling or a McDonald's or something, that way there are witness's.

have him drop you off somewhere to get a coffee while he gets the kiddo....

if he is concerned about scenes it may be time for him to modify to have the pick up done at a public place, then she has NO say also might be best if she is the one coming to YOUR house to pick him up....

I have to ask this....because my soon to be ex does the same thing with his girlfriend..
WHY NOT LET HIM GO BY HIMSELF......DAMN they are their kids.. Tell him to grow a set and deeal wih it!!!
Personally I think guys bring their girlfriends to show the Ex that they have moved on.. No other motive at all!!!

Because too many NCP's are accused of crap when they pick up their children, that is why!

Then take the cops.. they do this all the time..
The girlfriend has no business there.. sorry... THOSE CHILDREN ARE HIS AND HIS EX'x// Let them deal with it...

Why some NCP don't go by themselves or don't even go to pick up the child themselves is because in some states the ncp may designate any competent adult to pick up the child at the beginning of a period of possession and to surrender the child at the end of the period of possession. The cp may also designate any competent adult to be present to surrender the child at the beginning of a period of possession and to be present when the child is surrender at the end of a period of possession.

Also in some state the law provides that a county may establish a visitation center or a visitation exchange facility for the purpose of facilitating the terms of a court order providing for the possession of or access to a child. The parents pay a monthly fee for use of the exchange center. The parents do not encounter one another and that cuts down on the arguments and makes for a more peaceful exchange for the child.

That doesnt seem to be the issue here...
They dont have a designated person in this situation. The ex just doesnt want the GF there...People just need to grow up....

Sometimes the cops won't assist in an exchange.

How about taking a camcorder. This will helps aleviate any problems during an exchange. My stbx had to do this several times with the exchange with his daughter and ex.
