What is the name of your state? MI

My second eldest son is divorced and NCP of his daughter & son (ages 13 & 10 respectively).

My son is also remarried to a CP of a daughter & son (ages 8 & 7 respectively).

My son's home (bought & paid for) is quite small. A very small 2-bedroom. In fact, very small everyroom. All they can afford. Doing their best to save for a bit larger home, but that is going to take time. The have been married for 2 3/4 years and the four of them living there.

My son's step daughter & step son have shared a bedroom this whole time. Each having their own bed of course.

Being the trouble making vindictive person I know that NCP of those children to be, that NCP is now going to sue for full custody of the two children he says, based on the fact that both children (8 & 7/female-male) don't have their own bedrooms. Oh trust me, that NCP is the quintessential @$$#%!#. I've known him myself for many years. Wouldn't win any Father of the Year awards.

What does anyone think a judge may have to conclude with the sleeping arrangements of the two children? I mean, there is no other option, unless someone slept on a couch in the livingroom, and if that was done, that NCP would do his best to also raise a huge stink about that as well!

Thanks for your input!!

An alternative would be your son & wife get a pull-out sofa and THEY sleep in the LR, providing 2 bedrooms for the children.

Thank you moma_tigar. Yes, that may well be what they would end up having to do, to satisfy any court concern.

Thank you Veronica. I wish there were, but no, no salvageable basement.

Again, thank you both!

I believe that a basement bedroom IS legally considered a bedroom IF emergancy egress is provide. I know that HUD and other secondary market underwriters have certain requirements. There are codes dictating that. The homeowner can check with the local building inspector. to see what they consider constitutes a bedroom.

This can be either a deep egress window with oversized window well, or a dug out basement door with retaining wall of some type on either side.

Damn. Is it any wonder that so much of the rest of the world hates Americans. We pompous asses think that a child who doesn't have their own bedroom should be removed from the parents, while much of the rest of the world doesn't even have indoor shelter that is more than a room. Are some Americans just that damn ignorant, stupid and/or uneducated or is it a result of sniffing air-conditioning freon or exposure to exhaust fumes? Are we so damn hungup on sex that we get disturbed about butterflies making the beast with two backs (Yes, on Photocritique. com) some ding-a-ling thought that mating butterflies was to sexually explicit for the forum). If children are going to engage in sexual intercourse, does anyone think that different bedrooms is the deal maker or breaker.

My reaction would be, "Bring it on, baby. Maybe the judge will understand my need for increase in child support." I have a much greater chance of winning the Texas lotto than he does of changing custody on this basis. Incidentally, I don't even play the lotto.

The question neither asked nor answered is where the 13/14 yo kids stay when they spend time with Dad?

Well clearly, the visitation order should be modified to prevent the 13/14 year old step brother from being in the same household as an unrelated 7/8 year old male or female child. This smacks of sexualy exploitation and these children need protection from some hormone enriched unrelated male. I'm shocked that this has gone unaddressed in the order. (Sorry for using a pictorial but there are "readers" who lack the comprehension skills to recognize author's tone.)

LOL Well, I was trying to picture a place as small as Gramps indicated, and how 4 kids of those ages were fitting in a bedroom together.

Most folks have a standard possession and so the ncp has the children. In this case the ncp has the 8/7 at his house and the ncp (Gramps's son) has the 13/10 year old at his house. So the children are playing musical housing between cp and ncp.

Fair enough - I missed that. I'm used to parents wanting all the kids there at the same time so that they could get the other w/e's off. Thanks for straightening me out :D

Boxcarbill!!!!

First they are siblings by marriage, not unrelated. I have friends with numerous children who are genetically unrelated but related by law (by adoption) as siblings. The thought that legal siblings can't help themslves and must be kept seperated to avoid hanky panky is pretty hard to take. They would very much be upset with the implication that their kids can't be trusted together.
