What is the name of your state?What is the name of your state? OHIO, SHE IS IN FLORIDA.

HERE'S THE SITUATION. MY BOYRFIEND AND HIS X-WIFE HAVE 3 CHILDREN TOGETHER. AGES 1,4 AND 5. IN JUNE '04 THEIR DIVORCE PAPERS WERE SIGNED AND OFFICIAL. THEY HAD BEEN SEPARATED FOR A YEAR BEFORE THAT. WHEN THEY SEPARATED THEY LIVED IN AN APARTMENT HERE IN OHIO. THE SAME AREA THAT HIS FAMILY, (LARGE FAMILY) AND HER PARENTS AND BROTHER LIVED. WHEN THEY SEPARATED, HER PARENTS HAD RECENTLY MOVED TO FLORIDA, SO SHE MOVED DOWN THERE WITH THEM AND TOOK THE KIDS.

MY BOYFRIEND IS THE BEST FATHER, AND THOSE KIDS ARE HIS LIFE. HE PAYS THE CHILD SUPPORT AND THEN SOME. HE HAD HOPES SHE WOULD MOVE BACK AFTER THNGS CALMED DOWN, BUT NOW A YEAR LATER, SHE IS STILL STUBBORN AND SELFISH ABOUT THE WHOLE SITUATION, AND INSISTS THAT HE TOLD HER TO LEAVE, AND THAT THE KIDS ARE FINE WITHOUT THEIR DAD. ALL THEY HAVE IN FLORIDA IS GRANDMA AND GRANDPA AND MOM, WHO WORKS LATE NIGHTS AS A NURSE. HERE IN OHIO THEY WOULD HAVE OVER 13 COUSINS, 12 AUNTS AND UNCLES, AND GRANDMA AND GRANDPA TO PLAY WITH AND BE LOVED BY.

HE IS LOSING HIS KIDS, THE ONE YEAR OLD HARDLY EVEN KNOWS HIM. WHAT RIGHT DOES SHE HAVE TO KEEP THEM FROM THEIR FATHER? THE MOVE WAS NEVER AGREED TO. HE ONLY GETS TO SEE THEM 3 OR 4 TIMES A YEAR. IT'S NOT THAT SHE IS A BAD MOTHER, SHE IS A GOOD MOM, BUT EVERY KID NEEDS THEIR DAD. CAN WE MAKE HER MOVE BACK HERE TO OHIO WHERE THE KIDS BELONG?

The time for him to contest the move would have been a year ago and/or at the time of the divorce settlement. It's unlikely that he's going to be able to force her to move back now.

No, he really can't make her move back. She has been there too long. He might have been able to do it when she first moved, but now, a year later he can't. What kind of visitation schedule did he negotiate or get ordered in the divorce?

He should have acted immediately upon hearing she PLANNED a move. At most, right after.

Anyway, now he needs to petition the court for a visiation schedule, holidays, breaks, a good chunk of summer. And he should go for her picking up at least half the coost, as she is the one that moved.
