Child Custody Matter in Puerto Rico


My sister passed away in 2008, only three months after having given birth to a son. His father and not my sisters husband is a drug addict, etc. The child lived with my mother and I for about two months after he was born. The father thought there was social security money involved so he petitioned the court for custody. The judge granted him custody. During the time the child was in his custody, he moved from place to place. The child did not even have clothes and who know what other difficulty he was suffering. When the father realized there was no social security money he called me and we agreed that we (my mother) would take the child temporarily, that is all he would agree on. For us it was better than nothing, we did not want the child to continue to suffer. We addressed the court and were granted temporary custody. The child has been with our family for almost 11 months. Although the father calls us almost everyday, due his lack of things to do, he has been mostly unemployed so he has all day to call. But he has not sent us one red cent. I have been purchasing the childs food, diapers, etc. My sister provides medical insurance for him.
During the last three months the childs father married another looney just like him. My mother recently returned to Puerto Rico and left the baby with the father for unsupervised visitation, about a week later the wife put him out with the baby at 5am in the morning. My mother went to get him at that time. Now they have kissed and made up and she is saying she will try to get custody of the baby, but she suffers from a mental disability.
What are her rights vs. ours?
