What is the name of your state? IDAHO.
My friend "John"'s ex-wife is suing to modify their custody agreement to secure primary custody (currently it's 50/50,) and move the child out-of-state. It's for selfish reasons, of little benefit to the child, and we have a good case against her.
However, "John" just enrolled his daughter in kindergarten, and found out today that on the first day of school (August 23,) she will be in the possession of her mother!
"John"'s ex is trying to whisk their daughter away to Oregon by the first of September. She has selected a school for the child there, but has not, as yet, had her registered.
With the status of the child's very living arrangements in such flux, how does "John" ensure that his daughter shows up for class bright & early first-day morning?

"John" needs to find an attorney and file an immediate temporary order restraining the mother from removing the child from the state. As to the school issue, if a judge does not rule on it prior to September 1st, and the parents do not agree, then the mother will not be obligated to bring the child to the school of "John's" choice. I have see cases where judges do not regard education as an immediate issue - but it depends on the judge.
