Child in foster care in Kentucky but Father resides in Florida

:confused: What is the name of your state? Florida. My brothers daughter is in Kentucky and the mother had custody. (the mother didnt allow my brother to see his daughter) Well he got a phone call stating she was taken away because of abuse and was put in foster care. He is trying to get her out. The state of kentucky is sending some paperwork to him to fill out. Whats the process to getting his daughter out of the foster care? When hes done with the paperwork can he take the papers to kentucky and get his daughter out of the foster care or is there a hearing in court that takes place?? What happens can somebody please help. Thanks

If he is the legal father, what type of custody did they have? Did he pay child support? Did he get a visitation order? He can fill out the papers but a lot will depend on the answers to those questions, the fact that mom didn't let him visit isn't enough to automatically give him custody or make him a fit parent.

He didnt know she was pregnant when they split up. He found out by DNA recently that he is the father. She didnt let him see the child and didnt let him know that there was even a child. Yes he does pay child support 200.00 a week. Theres not a visitation order that we know of. The state of kentucky stated they will send him some paperwork to fill out (some about his job/income, residence, etc.) And he has a good job, a house, and he is supporting his son. So if anyone could help. It would greatly be appreciated :confused:

I would strongly recommend that he hire himself an attorney in KY. Trying to handle a case like this without one is a recipe for disaster.
