What is the name of your state? Wisconsin my sister-in-law died and she had custody of one of the children and the husband had custody of the other child but he is an alcoholic with several charges of domestic and child abuse against him including felony charges is there any way i can get custody of them or at least get a judge to order a temporary stay so we can try to get custody of the children before he takes them out of state? both children lived with us before when their mother was sick and couldn't take care of them now the father wants to take them to new mexico with him where they will have no family support or anyone that they know to turn to through this tragedy. the children are 10 and 13 and do not want to go with their father what can we do?

Your best option would be to talk to an attorney. If the father has proven charges of child abuse against him, you could stand a chance, but you would have to prove him unfit. Yes, you could sue for custody if you wish, but you should talk to an attorney to see what your chances may be depending on what evidence can found. Has the father been convicted of child abuse and domestic violence, or has he only been charged?
