Custodial Parent dies, does non-custodial parent have full custodial rights?

State of Kansas
Permanent Full Custody of 2 boys - ages 12 & 8 . Mother signed her parental rights over to ex-husband in 1996. No other court action taken since then. Ex-husband dies in accident. Does mother have full rights to custody of the children now? At present time they are staying with ex-husbands parents. What are the mothers rights and legal action to take to gain custody of her children. She has had constant visitation with them even though full custody was with ex.

In most states if this occurs, it's presumed that the NCP has automatic custody. I personally would call an attorney asap, then, go pick up the kids!
