What is the name of your state? Texas

My 15 year old daughter went to live with her dad January 2003...we did the custody amendement. She came back to live with me in October of 2003. My ex husband is ignoring our requests to have custody re-instated to me. However, my question is...do we necessarily need to have the order amended. I am not paying child support to him since she came back and he is not asking for it. I am just concerned about any "legal" ramifications in the future...Are there any to be concerned about if my ex is not "rocking the boat?"
