My fiance's x-wife has temporary custody of their granddaughter- we heard that if the parents or someone else does not contest or go back to court within a two year period, that this temporary custody would/could turn into permanent. The mother of the baby is unfit and virtually out of the picture, but the father is involved with his daughter as often as possible. The grandfather, myself, and the father think the baby would be better off with a shared/joint custody with us.....the grandmother she is with now, is not stable in many ways. We do not feel it would be good for the baby who will be 2 years old this month. She has had temporarycustody for over a year now and if that is true about the two year period, we will want to do something soon. Thank you

You can always file Temp Custody Orders to state your reasons for the current guardian being unfit. I'm not too sure if you (as grandparents) should file or the child's father.
