State of VA. I'm going to court next month to establish custody/visitation. My child's father has attended mediation and our status hearing. He has not seen our child since June 2001. After the hearing, he said that he is not going to pursue the matter any further, attend any parenting classes or show up for court. He refuses to have anything to do with our child anymore. My lawyer filed a motion to dismiss his petition. I am filing for sole legal/physical custody with no visitation under the circumstances. What's the likelyhood that the judge will grant this? If the father doesn't participate or see the child at all? Thank you.

he doesn't show, decides he doesn't give a rat's a$$, I'd say your chances are pretty damn good!
